Terms of Service

Please read these Terms of Service carefully before using the Ccyfer platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Ccyfer AI-powered marketing intelligence platform ("Platform") operated by Ccyfer Technologies ("we", "us", "our").

By creating an account, requesting access, or using any feature of the Platform, you represent that: (a) you are at least 18 years of age; (b) you have the authority to enter into these Terms on behalf of yourself or your organisation; (c) you agree to be bound by these Terms and our Privacy Policy.

Platform Description

Ccyfer is an AI-powered marketing intelligence platform that provides tools for marketing strategy, content creation, campaign planning, SEO analysis, audience research, and related marketing activities ("Services").

The Platform uses large language models (LLMs) and AI systems to generate marketing content and strategy. You acknowledge that:

AI-generated outputs are probabilistic and may contain inaccuracies, errors, or omissions

You are responsible for reviewing, editing, and approving all AI-generated content before use

AI outputs do not constitute professional legal, financial, medical, or regulatory advice

The Platform is a tool to assist human judgment, not replace it

Account Registration and Access

Access to the Platform requires an approved account. To create an account:

You must provide accurate and complete registration information

You must submit an access request that is approved by a platform administrator

You are responsible for maintaining the security of your credentials

You must notify us immediately of any unauthorised access to your account

We reserve the right to deny access requests, suspend accounts, or terminate accounts at our sole discretion, with or without prior notice, for violations of these Terms or for any other reason we deem appropriate.

Subscription Plans and Payments

Access to the Platform is provided on a subscription basis. By subscribing, you agree to:

Pay the applicable subscription fees in advance for each billing period

Provide accurate and current billing information

Fees are non-refundable except as required by applicable law or as expressly stated in our refund policy

Subscriptions automatically renew unless cancelled before the renewal date

We may change subscription fees with 30 days' written notice

AI call limits reset monthly on your billing anniversary. Unused calls do not roll over. Overages are not permitted — tools become unavailable until the next billing period or upon plan upgrade.

Permitted Use

You may use the Platform for lawful marketing and business purposes consistent with these Terms. Specifically, you may:

Use the Platform for your own business or for clients you represent as a marketing professional

Export and use AI-generated outputs for commercial purposes

Share outputs with your clients under white-label arrangements (where your plan permits)

Allow authorised team members to use the Platform under your subscription (within seat limits)

Prohibited Use

You must not use the Platform to:

Generate content that is defamatory, harassing, threatening, or otherwise unlawful

Create or distribute spam, phishing content, or deceptive advertising

Generate content that infringes on third-party intellectual property rights

Produce content that promotes discrimination, violence, or illegal activities

Attempt to reverse engineer, decompile, or extract the Platform's source code or AI models

Use automated scripts, bots, or scrapers to access the Platform

Circumvent usage limits, access controls, or billing systems

Share account credentials with persons not covered by your subscription

Use the Platform to develop competing products or services

Generate content involving minors in any sexual or exploitative context

Violation of prohibited use provisions may result in immediate account termination without refund.

Intellectual Property

Your Content: You retain all intellectual property rights in the data, information, and materials you submit to the Platform ("Your Content"). You grant us a limited, non-exclusive licence to process Your Content solely for the purpose of providing the Services.

AI Outputs: Subject to your compliance with these Terms and payment of applicable fees, AI-generated outputs produced through your account are assigned to you and you may use them for any lawful commercial purpose. We make no warranty that outputs are free from third-party intellectual property claims.

Platform IP: The Platform, including its design, code, AI systems, and methodologies, is our proprietary technology protected by intellectual property law. Nothing in these Terms grants you any right in the Platform itself.

Confidentiality

Each party agrees to maintain the confidentiality of the other's non-public information. You agree to:

Keep your account credentials confidential

Not disclose non-public Platform features, pricing structures, or methodologies

Ensure your team members are bound by equivalent confidentiality obligations

We agree to keep your client data and business information confidential and not disclose it except as required to provide the Services or as required by law.

Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We do not warrant that the Platform will be error-free, uninterrupted, or meet your specific requirements

We do not warrant the accuracy, completeness, or fitness for purpose of any AI-generated output

We are not liable for any business decisions made based on Platform outputs

IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID IN THE 3 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Ccyfer Technologies and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your violation of these Terms

Your use of AI-generated outputs

Your Content or data you submit to the Platform

Infringement of third-party rights through your use of the Platform

Termination

Either party may terminate these Terms:

You may cancel your subscription at any time through your account settings; access continues until the end of the current billing period

We may suspend or terminate your account immediately for material breach of these Terms

We may terminate the Platform with 30 days' notice; pro-rated refunds will be issued

Upon termination, your right to access the Platform ceases immediately. We will retain your data for 90 days after termination, during which you may request an export. After 90 days, your data will be deleted.

Governing Law and Disputes

These Terms are governed by the laws of India, specifically the laws of the State of Maharashtra. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes informally by contacting legal@ccyfer.in with a written description of the dispute. We will respond within 14 days.

Changes to Terms

We may revise these Terms at any time. Material changes will be notified via email 30 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Platform before the effective date.
